Terms and Conditions
1. General
The Arden Automobilbau GmbH (hereinafter: Seller) exclusively sells and delivers according to the following terms and conditions. Contrary general business customer conditions are herewith expressly not accepted.
2. Orders
The display of goods in the online shop is not an offer, but a non-binding invitation for the customer to order. By ordering the goods, the customer makes a binding offer of contract. The seller will confirm receipt of an order electronically without delay. This confirmation of receipt, as well as receiving a telephone order, is not a binding order acceptance of the Seller With the confirmation of an order, the customer will be sent the legally effective general terms and conditions and the distance sales conditions. The seller is entitled to accept the binding offer of the customer within 7 working days or with an electronic order within 3 days, from receipt of the order.
3. Right of revocation
Consumers will receive a right of revocation. Details are provided in the distance sales conditions. The right of revocation on distance purchase orders shall be excluded if the purchased product is manufactured according to customer specifications or clearly tailored to personal needs.
4. Supply and delivery dates
Indication on the availability and the delivery dates can be found in the product description in the online shop. The customer can choose if the goods are
collected by his selected installation partner or select shipping. A delivery is made exclusively within Germany.
5. Guarantee and reclamation
The statutory provisions apply to the warranty rights. The warranty period is two years from delivery of the goods with new goods and one year from delivery for used goods. Customer complaints can be made to:

6. Liability
The liability of the seller – on whatever legal grounds – is limited to damages that you or your agents intentionally or negligently precipitated or by slight negligence or a breach of the fulfillment of the essential duties of the purpose of contract. In cases of slight negligence, the liability of the Seller is limited to the amount of comparable transactions of this kind of typical damage, that were predictable at conclusion of the contract or at the latest at the inspection. Specifically exempted are claims from product liability or warranty claims as well as claims based on the loss of life, limb or health.
7. Due Diligence
The customer must ensure that all changes and modifications to his vehicle, if it participates in public traffic, be registered under the statutory provisions in his vehicle permits. (vehicle registration document and vehicle). The purchaser must present the vehicle, if necessary, to the Technical Inspection Association (TÜV) or other testing organization to achieve the registration of the amendments made to the motor vehicle or a part of the motor vehicle in the vehicle documents.
8. Reservation of ownership
The seller retains the title to the goods sold until receiving the full payment of the purchase price.
9. Prices and terms of payment
The prices of the Seller are intended as final prices and include VAT, plus shipping. Shipping costs are only charged if the customers orders are below 20,00 Euro with shipping inside Germany and 50,00 Euro is shipping is inside Europe or shipping outside of Europe and lower than 100,00 Euro. In these cases, the flat rate shipping fees for shipping within Germany amount to 5, 90 Euro, within Europe 8.90 Euro and shipping outside of Europe 14.90 Euro.
Otherwise the shipping will be free of charge. Transport is made exclusively with payment on delivery, funding, advance payment or by credit card.
In case of cancellation by the customer he must pay the return costs when – the delivered goods correspond to the ordered goods and when the price of the returned goods does not exceed 40, 00 Euro or if the price of the goods is higher and at the time of the cancellation you have not made a payment or made a contractually agreed part payment. Otherwise the return transportation is free of charge for the customer.
Compensation for the customer is only possible with undisputed or legally established claims.
10. Jurisdiction and applicable law
For all disputes arising out of or in connection with the contracts between the seller and customers and between the Seller and persons who do not have their domicile or habitual residence within the territory of the German Code of Civil Procedure, the place of jurisdiction is the abode of the seller. The legal relationship between the seller and the customer out of or in connection with this contract underlies the Law of the Federal Republic of Germany excluding the UN Convention on the International Sale of Goods (CISG)
